End user license agreement

This user agreement (hereinafter referred to as the “Agreement”) governs the relationship between the Administration providing services for the use of the software product “NardGammon. Long and Short Backgammon” (hereinafter referred to as the “Game”), posted on the Internet on the website NardGammon.Com and other domains belonging to the Administration’s intellectual property rights, as well as to information and entertainment resources related to the specified Game and by the user of the Game (hereinafter “the User”).

1. General Provisions

The user, accepting the terms of this Agreement, confirms that he has reached the age of majority, and has the right to conclude this Agreement, minors are required to obtain permission from parents or guardians to use the services of the Game. If, in accordance with the laws of your state, it is forbidden to receive game services online or there are other legislative restrictions, including restrictions on the age of admission to such services, you are not entitled to use the Game and undertake to immediately stop using the Game.

The consent of the User with the provisions of this Agreement is a prerequisite for the start of use of the Game. Registration in the Game, installation, copying, or other use of the Game confirms the User’s accession to this Agreement. If the User does not accept the terms of this Agreement, then he has no right to use the Game. The agreement is valid until the moment of its termination on the initiative of the Administration, or on the initiative of the User.

By registering in the Game, the User agrees to receive information from the Administration, including, but not limited to: news, notices, notifications, reminders, warnings related to the Game, by e-mail, to the address specified by the User during registration, or the address indicated by him in the process of using the Game;

This Agreement may be amended by the Administration at any time without prior notice to Users. The current version of the Agreement is located on the Game website. The player is recommended to check this Agreement on the website of the Game at least once every 60 days.

In accordance with this Agreement, the Administration provides the following services to the User:

– access to the game server and participation in the game process;

– access to information resources of the Game;

– access to other services of the Game.

The software required to access the Game is freely available on the official website of the Game. The user independently pays for access to the Internet at his own expense.

The use of the Game is made by the User solely on his own and on an “as is” basis, that is, the Game Administration is not liable to the User under any circumstances for any direct, indirect, incidental, special, punitive, loss of profit, damage to reputation or other damage, that the User may have in connection with the use of the Game or the inability to use it.

The Consent of the User with the provisions of this Agreement confirms that he is notified that regular prolonged stay with a personal computer can cause various complications of the physical condition.

The User is hereby notified that the Game may provide for various emotional effects that, under certain circumstances, may cause persons prone to epileptic or other nervous disorders to aggravate these conditions, and the User guarantees that he does not suffer from these disorders, or undertakes Do not use the game.

The copyright holder and developer of the Game is the Administration. All copyright, related and other rights to the Game, including game characters, program code, Game files, graphics, soundtracks, dialogs and texts, as well as other copyright objects belong to the Administration and are protected by the legislation of the Russian Federation on the protection of intellectual property and copyright rights. Unauthorized use of the Game or elements of the Game is prohibited.

All trademarks or other designations of goods or services used or mentioned in the Game belong to their legal owners. All other rights not expressly indicated as belonging to third parties belong to the Administration or the legal owners of such rights.

Any public or additional (paid) services or services in the Game are provided exclusively by the Administration. The receipt of gaming services or services from other third parties may result in the User’s refusal to provide the services of the Game. The price of paid services is set by the Administration at the time of their sale to the User and can be changed at any time.

To collect statistical data and identify Users, the Administration can track and save information about the IP addresses of the User from which the Game is accessed, use technical information files (cookies) placed on the user’s personal computer through the client part of the Game.

It is forbidden to use fraud to pay for services in the Game. Fraud is considered to be unpaid by Users SMS or SMS sent by Users through unauthorized access to communication services of a mobile operator.

The agreement is concluded for an indefinite period.

2. User rights, obligations and restrictions.

2.1. User obligations:

2.1.1. User agrees to comply with the terms of this Agreement;

2.1.2. If an error is detected in the Game software, the User is obliged to immediately inform the Administration about it through game mail, messages on the Game forum or to the contact email address indicated on the Game website;

2.1.3. The user is obliged to keep secret the password chosen by him during registration;

2.1.4. The user is personally responsible for maintaining the confidentiality of the password;

2.1.5. The User agrees to respectfully and correctly treat other Game Users and representatives of the Administration, namely: not to use profanity, not to threaten violence and physical harm outside the Game;

2.1.6. The user agrees not to advertise porn sites, drugs and resources containing such information, or to commit other similar actions.

2.2. User prohibited:

2.2.1. Use the Game for personal commercial or political purposes;

2.2.2. Register more than two accounts in the game;

2.2.3. Transfer your registration data to a third party, both free of charge, and for game or real money;

2.2.4. Register a player’s nickname containing profanity or insults;

2.2.5. Use profanity in game and personal chats;

2.2.6. To insult other members of the portal;

2.2.7. Show “unsportsmanlike behavior” – any player’s actions that contradict the game process and the rules of the game;

2.2.8. Upload a picture for an avatar of a pseudonym containing ads, images of an erotic or pornographic nature;

2.2.9. Use the program errors of the Game (for personal purposes or otherwise), transfer information about their availability to third parties, with the exception of the Administration;

2.2.10. Decompile the game and interfere with the program code; modify and modify the algorithms of the Game;

2.2.11. Modify, translate or make any attempts to identify the source code of a program or network algorithms; and also use the best practices of the game based on their developments;

2.2.12. Hack and steal accounts of other Users;

2.2.13. Distribute links to Internet sites whose contents cause computer malfunctions or are aimed at illegally gaining access to the accounts of other Users, links to software that contains viruses or other harmful elements;

2.2.14. Use and distribution of any software tools not provided for by the Game, which can provide facilitation, automation of the game process or server malfunctions;

2.2.15. Emulate the protocol used in the Game;

2.2.16. Take any action aimed at disrupting the normal operation of the website of the Game, or of the Game itself; damage to the Game (including the integrity of equipment, software and databases owned by the Administration);

2.2.17. Restrict other Users access to the Game or prevent other Users from using the Game;

2.2.18. To commit or incite third parties to commit acts prohibited by applicable law, including those related to drug trafficking, terrorist activities, calls for the overthrow of a legally elected government, extremist orientation; pornography, any form of discrimination based on gender, age, religion or other grounds;

2.2.19. To distribute in any way materials propagating, expressing rejection or hatred of any religion, culture, race, nation, people, language, politics, ideology or social movement;

2.2.20. Disseminate in any way personal information regarding players or third parties whose use may harm them;

2.2.21. Publish and send messages provoking and / or containing a call for violation of this Agreement by other Users;

2.2.22. Impersonate another person or representative of the Administration, as a moderator of the Game.

2.3. The user has the right to:

2.3.1. For free access to the Game;

2.3.2. For technical support;

2.3.3. Use the Game on a computer, tablet, phone whose technical specifications must meet the requirements of the Game;

2.3.4. Use the paid services of the Game;

2.3.5. To change your registration password;

2.3.6. Stop membership in the gaming community; for this, the User must send a letter of application to the contact e-mail: support@nardgammon.com;

2.3.7. Under your personal responsibility, post on the information systems of the service any information to the extent provided for by the technical capabilities of the service; Administration is not responsible for the content and safety of such information.

2.4. Responsibility for violation of the rules:

2.4.1. Responsibility for observing the rules of the Game and the Agreement lies with the owner of the account, regardless of who performed the actions under this account;

2.4.2. The user agrees that in case of violation of this Agreement, the Administration has the right to apply sanctions at any time, at its discretion: warning, renaming of the account, temporary blocking of the account, permanent blocking of the account, or other actions.

3. Administration Rights.

3.1. The administration has the right to close or limit the functionality of the Game at any time without any prior notice to the Users.

3.2. The administration has the right, without any prior notice, to refuse to the User the services of providing the game service for violation of the Agreement.

3.3. The administration has the right to transfer data about a user who violates the Agreement or current legislation to law enforcement agencies.

3.4. The Administration reserves the right to remove any information or materials from its servers if it is, from the point of view of the Administration only, unacceptable, undesirable or violates this Agreement.

3.5. The administration has the right at any time to change the rules of the Game, the conditions for the provision of services and / or their contents, including the introduction of a service fee, which until then was presented free of charge, as well as change the price of services; the Administration shall notify the User of this by posting relevant information on the Game’s website.

3.6. The administration has the right to prohibit the use of any account without explanation.

3.7. At the initiative of the Administration, sanctions can be applied to any User, regardless of whether he used the paid services of the Game or participates in the Game for free; however, the money received for payment of additional services from the User whose account is blocked or deleted is not returned. The decision to provide compensation is taken by the Administration at its sole discretion.

3.8. The administration has the right to resolve disputed issues not specified in this Agreement, at its discretion.

3.9. The administration has the right to unilaterally refuse this Agreement and stop providing services for the use of the Game without prior notice.

4. Responsibility of the Administration.

4.1. Administration is not responsible to the User for the actions of other users.

4.2. The administration does not guarantee that the game software does not contain errors or will function without interruption.

4.3. The Administration is not responsible for temporary technical failures and interruptions in the operation of the Game, for temporary failures and interruptions in the operation of communication lines, other similar failures, as well as for malfunctions of the computer from which the User uses the Game.

4.4. The administration is not responsible for all risks and losses that may be associated with the disclosure by the User of his password for access to the Game.

5. Rules of the game.

5.1. It is forbidden to initiate match matches, i.e. matches, the result of which is agreed in advance by the participants.

5.2. It is forbidden to violate the rules of behavior in the chat, use profanity, insult, humiliate or defame the honor and dignity of the Administration or other players and third parties outside the game.

5.3. It is forbidden to discuss other computer games or game services in the general chat channel.

5.4. It is forbidden for personal purposes to deceive or misinform the Administration.

5.5. It is forbidden to register aliases with names:

– containing a meaningless set of characters, profanity, insults;

– affecting policies that incite ethnic hatred, which are links to other sites and other resources;

– similar to the character names used by the Administration.

5.6. It is forbidden to receive material benefits in exchange for game currency.
